Terms of Service

Agreement to terms

These Terms of Service govern the use of Capi Video, provided by Guilherme Lico Barscevicius Consultoria em Tecnologia da Informação, CNPJ 36.742.159/0001-29, with its registered office at Av. Paulista, 171, Bela Vista, São Paulo/SP, CEP 01311-904. By accessing or using Capi Video, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.

Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to create or use an account. By creating an account you confirm that you meet this requirement. If you publish content directed at children or adolescents, you are responsible for obtaining the parental consent the law requires for your audience, including under Brazil's General Data Protection Law (LGPD, Art. 14) and the GDPR. We close accounts we learn belong to someone below this age.

Service description

Capi Video provides a video hosting, management and analytics platform for content creators and businesses. Features include video upload and processing, embed code generation, viewer analytics, caption transcription and translation, and integration with infoproduct platforms.

AI credit packs

Each pack contains 500 AI credits, valid for 12 months from payment. Purchased credits are used after the plan's monthly credits and cannot be transferred between workspaces. A refund removes credits in proportion to the amount refunded, up to the pack's unspent credits. While a chargeback is open the pack's credits are held, and a chargeback the payer wins removes its unspent credits.

User responsibilities

You are responsible for maintaining the security of your account, ensuring you have the rights to upload and distribute your content, and complying with all applicable laws regarding your content and use of the platform.

Acceptable use

You may not use Capi Video to host illegal content, infringe on intellectual property rights, distribute malware, engage in harassment, or any activity that violates applicable laws. We reserve the right to remove content and terminate accounts that violate these terms.

Intellectual property

You retain all rights to your content. By uploading content, you grant us a limited license to process, store, deliver, and display your content as necessary to provide our services. We retain all rights to the Capi Video platform and technology.

Processing data on the seller's behalf

When you use Capi Video to publish videos to your audience, you are the controller of your viewers' and buyers' personal data, and Capi Video is the processor that processes it on your behalf (LGPD Art. 5 VI and VII, and Art. 39). In that role, Capi Video:

  • processes that data only to provide the service, under these Terms and the settings you choose in the workspace, which are your instructions;
  • keeps the data confidential and protects it with the security measures described in the Privacy Policy;
  • uses only the sub-processors listed in the Privacy Policy and announces changes to that list by updating it;
  • helps you answer data subjects, including through the privacy request page, which exports or deletes the data linked to a confirmed email; you authorise Capi Video to carry out on your behalf the requests confirmed there;
  • tells you, without undue delay, about security incidents affecting that data, so that you can comply with LGPD Art. 48;
  • deletes the data when the service ends: a deleted workspace stays in the trash for 30 days and is then deleted, and backups are replaced within 5 weeks.

You are responsible for having a legal basis for the data you process, informing your audience in your own privacy policy, obtaining the consent required for the pixels you turn on, and answering data subjects' requests. The sales platforms and pixels you connect process data under their agreement with you.

Limitation of liability

Capi Video is provided "as is" without warranties. We are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

Termination

Either party may terminate this agreement at any time. Deleting your account immediately deletes your account, its workspaces and their content. Before deleting your account, you can export your data from Minha conta. Provisions that by their nature should survive termination will remain in effect.

Governing law

These terms are governed by the laws of Brazil. Any disputes will be resolved in the courts of São Paulo, Brazil.

Changes to terms

We may update these terms from time to time. We will notify you of material changes via email or platform notification. Continued use after changes constitutes acceptance.
